Terms and Conditions


This web site (including any web page associated with it, the “Site”) is property of the Joint Underwriting Association for the Compulsory Motor Vehicle Liability Insurance (“ASC”, for its Spanish Acronym). ASC Headquarters are located on Las Vistas Shopping Village 300 Ave. Felisa Rincón de Gautier Carr. PR 199, Local #3 San Juan P.R. Through the Site,  ASC provides access to corporate information for the company and to all transactional areas necessary for the electronic filing or follow up of any claim.

These Terms and Conditions (“TCs”), together with the Confidentiality Policy, constitute a binding agreement between ASC and any person who accesses or uses the Site, its content or the services provided within it.

A. CONSENT

WHEN YOU REGISTER, ACCESS, VISIT, USE OR INTERACT IN OR WITH ANY PART OF THE SITE OR BY ACCESSING OR USING ANY OF THE SERVICES PROVIDED IN IT YOU ACCEPT AND RECOGNIZE THAT THESE TCs AND THE CONFIDENTIALITY POLICY CONSTITUTE A BINDING AGREEMENT BETWEEN YOU AND ASC, AND THAT YOUR ACCESS OR USE OF THE SITE OR THE SERVICES PROVIDED IN IT ARE SUBJECT TO THE PROVISIONS OF THESE TCs (AND THE CONFIDENTIALITY POLICY), INCLUDING, BUT NOT LIMITED TO, PROVISIONS ON THE SELECTION OF FORUMS, SETTLEMENT AGREEMENTS AND LIMITS OF LIABILITY.

B. ACCESS AND REGISTRATION

To access and use the Site you shall have access to a computer with adequate software and Internet access. The access or usage of some of the services available through the Site could require you to possess certain types of equipment or additional devices.

To access some of the services provided in the Site or to obtain some of the information that may be provided by the Site, you may be required to register in the Site and create an access account with a unique password. You shall provide the requested information in the registration form and said information must be true, precise and complete. Any password that you may use to access or use the Site or the services available through the Site is personal and not transferrable. If  ASC comes to know or suspects that you have provided some information that is not correct, updated or complete, ASC will have the right to limit or terminate your use or access to the Site. You are responsible for making good use of your password. You shall keep your password secret and shall notify ASC immediately as soon as you know of any unauthorized use or access of your password.

If you subscribe, request or accept to receive information or messages by email or text messages on the email address or mobile phone number that you provide when you register, you accept and acknowledge that your telephone service provider may impose certain charges for messages or data. You accept and acknowledge that you will be solely and exclusively responsible for the payment of said charges. You may opt out of receiving those messages at any time in the future. In the case of emails, you may opt out of receiving messages from ASC by following the instructions that appear in the messages to “UNSUBSCRIBE”. In the case of text messages, you may opt out of receiving messages in the future by sending the word “STOP” in a message to the appropriate number or code.

The Site, its contents or the services accessible through it are not intended for minors under the age of sixteen (16). No registration will be authorized and no information will be gathered from minors under the age of sixteen (16).

Subject to availability, you may use or access the Site or the Services available through the Site to submit claims related to a vehicle involved in an accident that is covered by ASC’s compulsory vehicle liability insurance. Filing a claim through the Site or through the services available within the Site does not require ASC to provide coverage for the damages claimed. ASC will evaluate all the information you provide and will launch an investigation to determine if your claim is valid in accordance with the laws and regulations applicable to the compulsory vehicle liability insurance.

C. RESTRICTIONS OF USE OR ACCESS

You may access or use the Site, its content or the services provided within it only for the purposes expressly permitted by ASC. You may not modify, copy, distribute, show, or exhibit, send, execute, reproduce, publish, license, create derivative works, include in collective works, transfer or sell any content, material, information or service accessed in or through this Site.

As a condition of access or use of the Site, you warrant and represent that you will not use or access the Site for purposes that are illegal or prohibited under these TCs or under any other applicable policy or rule. It is prohibited to establish links to the Site, including links that may implicate  ASC or the Site are related to you, or that sponsor, endorse, or support you or a third party (or your assets or services or those of any other third party).

You will not be able to establish inline or framing links to the Site. It is prohibited to use or access the Site in such a way that it may disable, overload, damage or affect the Site or interfere with the use or access of the Site or the services that may be accessible within the Site by third parties. You agree not to obtain or try to obtain material, content or information by means that are not accessible or that are not provided for these intended purposes in or by the Site.

You agree not to use or access the Site or the services provided within the Site to make vulnerable, affect or modify the security, system resources and accounts in the Site.

D. PROPRIETARY RIGHTS

All the rights for the Site and for the information, material, content or services provided or accessible through the Site are the sole property of  ASC (or people contracted by the ASC). You agree not to reproduce, modify, publish, duplicate, copy, distribute, sell, download, exploit for business purposes or use for any other purposes not authorized in writing by ASC, the Site or the information, material, content or services provided or accessible within the Site. You may print a copy of the information, materials, or content provided or accessible within the Site only for your personal use. Any use or access allowed for the Site or the information, materials, content or services provided or accessible within the Site does not grant you proprietary rights over them.  ASC expressly prohibits the use of the information in the Site for business purposes. In the same manner, no part of the Site content may be used by ASC competitors for any purpose whatsoever.

E. LINKS

The Site may contain hyperlinks to other sites or web pages or third party content that does not belong or is not controlled by ASC. Said links are provided to facilitate the search for information or services on the Internet, but do not constitute an endorsement or sponsorship by  ASC.  ASC is not nor will it be responsible for your access or use of links to third party web sites or web pages, nor for the content, products or services available, offered or provided in or through said sites or pages. Any use of the links or access to the sites or pages linked to them will be at your own and exclusive risk.

F. USE OF INTERACTIVE SERVICES IN THE SITE

The site may contain interactive services, such as chats designed to allow you to contact our service representatives directly. You agree to use said services only to send and receive messages or content related to your claims or status of your claims about any accidents where the vehicles involved were insured by the compulsory vehicle liability insurance of  ASC. Among other things, you agree and promise not to upload, send, submit, publish or transmit any Site-related material or content that: (i) you have no right to use, including third party material or content; (ii) infringes on third party rights (including, but not limited to, copyright, moral rights of authors, rights over trademarks or brand names, rights to one’s likeness, right to privacy, right over patents, etc.); (iii.) be it defamatory, libelous, obscene, pornographic, or indecent; (iv) is not associated with a claim for a vehicle in an accident that was covered by ASC’s compulsory vehicle liability insurance; (v) constitutes a threat or harassment; (vi) contains information or content contrary to the applicable laws and regulations (including but not limited to the laws that prohibit child pornography or the exploitation of minors); (vii) through which you impersonate another person; and/or (viii) are contrary to any ASC policy or rule.

 ASC reserves the right to monitor your use or access to the Site in order to determine if you comply with everything established in these TCs.  ASC reserves the right to terminate your use or access to the Site or the services provided within it at any moment with or without previous notification and for any reason. Notwithstanding the foregoing, you will be the only one responsible for any information, material or content submitted by you through the interactive services of the Site.

G. CONTENT PROVIDED BY YOU

When submitting any material, content, information, writing or photography to or through the Site or the services available on the Site, you grant  ASC a global, perpetual, irrevocable, and loyalty-free license to use, reproduce, distribute, modify, adapt, create derivative works, translate, publish, and exhibit them in any format, medium or technology known now or known or developed in the future with the intention to transmit your claim associated to a damaged vehicle covered by ASC compulsory liability insurance. You guarantee and represent that you have the appropriate rights, licenses or authorizations to submit any materials, content, information, writing or photography to or through the Site or the services available in the Site, and that they do not infringe or violate the rights of third parties (including, but not limited to: copyright, moral rights of authors, rights over trademark or brand names, right to privacy, rights to one’s likeness, right over patents, etc.). Any materials, content, information, writing or photography to or through the Site or the services available on the Site that you submit or send to or through the Site or the services available within the Site that are not associated with a claim or with the status of a claim associated to a damaged vehicle covered by ASC compulsory vehicle liability insurance may be discarded or rejected by ASC.

H. DISCLAIMER OF WARRANTIES

YOUR ACCESS AND USE OF THE SITE AND THE SERVICES RENDERED UNDER IT ARE AT YOUR OWN RISK. THE SITE, ITS CONTENTS AND THE SERVICES AVAILABLE THROUGH THE SITE ARE OFFERED ‘AS IS’ AND AS AVAILABLE. ASC DOES NOT OFFER ANY TYPE OF WARRANTY, EXPLICIT OR IMPLICIT, ABOUT THE SITE, ITS CONTENT AND THE SERVICES AVAILABLE THROUGH THE SITE AND, SPECIFICALLY, DOES NOT OFFER ANY MERCHANTABILITY WARRANTY, FITNESS FOR A PARTICULAR PURPOSE OR THE NON-VIOLATION OF PROPERTY RIGHTS. THE ASC EXPRESSLY DECLINES TO THE HIGHEST DEGREE ALLOWED BY LAW EVERY EXPRESSED OR IMPLICIT WARRANTY AND THE NON-VIOLATION OF PROPERTY RIGHTS.

ASC DOES NOT GUARANTEE THAT THE SITE, ITS CONTENTS AND THE SERVICES AVAILABLE THROUGH THE SITE, WILL BE APPROPRIATE OR WILL BE AVAILABLE OR WILL BE USED OR ACCESIBLE OUTSIDE OF THE COMMONWEALTH OF PUERTO RICO, WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY CONTENT, SERVERS, MATERIALS OR SERVICES, WHICH ARE ACCESSED IN OR THROUGH THE SITE WILL NOT CONTAIN VIRUSES OR OTHER DAMAGING ELEMENTS.

I. LIMITATION OF LIABILITY

You accept that ASC, its officials, staff, agents or directors will not be responsible under any circumstances for any extraordinary, ordinary incidental, direct, indirect, punitive, real, continuous, special, exemplary damages, nor for any mental anguish or other similar damages, associated with your use or access to the Site, its content or the services available within the Site, even if ASC was advised of their possibility.

J. INDEMNIZATION

You agree and are committed to defending, indemnify and hold harmless ASC from and against any claim, action, damages, sentence, civil or criminal liability, penalty, charge, lien, expense or loss of any kind, including, but without being limited to, attorney’s fees, which may be incurred, suffered or be required to pay associated with the defense, transaction or final decision of any claim, action, lawsuit, or proceedings caused directly or indirectly for: (i) non-compliance or violation of these TCs or any other ASC policy or rule that you must obey; (ii) any act or omission done by you or applicable to you; (iii) not complying with any law, rule, regulation, ordinance or any other legal obligation applicable to you; and/or (iv) a violation of the rights of any third party.

K. RATIFICATION OF INFORMATION PROVIDED BY MINORS

If you have not been emancipated and have not reached the age of twenty-one (21) years (but are older than sixteen (16) years), ASC reserves the right not to use the data, information or admissions of liability you may provide through the Site for the purposes of resolving a claim, until it has been ratified by your mother, father, legal guardian or person with legal rights over you. ASC also reserves the right to prohibit claims or notifications about accident events to be presented within the Site by persons who have not reached the age of twenty-one (21) years.

L. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

You accept and acknowledge that all the rights over trademarks, service marks, logos and works protected by copyright that appear or are included in the Site are the exclusive property of ASC (or in some cases of the people hired by ASC). Any unauthorized use of these trademarks, service marks, logos and works protected by copyright by you may constitute a violation of the intellectual or industrial property rights violation of ASC (or of third parties hired by ASC).

ASC reserves the right to, at its sole discretion and under particular circumstances, terminate, cancel or disable, immediately and without previous notice, your use and access to the Site or your registration or account on the Site if you infringe on ASC’s or a third party’s intellectual or industrial property rights.

M. YOUR ACKNOWLEDGEMENT THAT YOU WILL FILE A CLAIM ASSOCIATED WITH A VEHICLE RELATED TO YOU

You accept and acknowledge that you are filing a claim associated with a vehicle related to you, either because you are the registered owner of the unit, the person with physical possession of the vehicle or you were driving the motor vehicle at the time of the accident. By accepting these TCs, you accept and assert that you are filing a claim associated with that vehicle related to you and not for any other vehicle that is in no way related to you. By accepting these TCs you also assert, under penalty of perjury, that your identity is the one indicated on the claim and that you are not impersonating, faking or simulating the identity of any other person, including the party that is legally liable for the traffic accident. You also assert that the information provided as part of your claim is correct and precise, to your best knowledge and understanding.

N. ACCEPTANCE OF HAVING READ AND UNDERSTOOD THE PROVISIONS ABOUT FRAUD IN THE CLAIMS PROCESS

When you accept these TCs, you confirm your knowledge that providing false, erroneous or incorrect information, as part of a claim or the action of impersonating, simulating or faking the identity of another person may constitute fraud, a conduct classified as a felony under Art. 27.270 of the Puerto Rico Insurance Code, 26 L.P.R.A. §2736. The penalty for fraud under the Puerto Rico Insurance Code is a fine of not less than five thousand dollars ($5,000.00) and not greater than ten thousand dollars ($10,000.00) or incarceration for a fixed term of three (3) years, or both sentences combined. In addition, any person, who as a result of committing fraud benefits in any way from obtaining insurance or payment for a claim from an insurance policy, will be subject to restitution of the amount of money resulting from the fraud. When you click on accept the TCs, you certify that all the information, statements, assertions or documents included on the Site are true and correct.

O. MISCELANOUS

Nothing established in these TCs is to be interpreted as the start of an employer/employee relationship between ASC and your person, a joint venture, agent/representative or society.

These TCs do not modify or amend the terms and conditions of any other contract or agreement that may exist between ASC and you.

Subject to the provisions of the Confidentiality Policy, ASC reserves the right to disclose any information, materials or content provided by you or your personal information if: (i) ASC is required by lay, regulation or court or administrative order to provide said disclosure; (ii) in order to defend itself in case any claim is presented against it associated with said information, materials or content; (iii) to enforce these TCs; and (iv) to protect the property, rights or safety of SC, its employees or third parties.

ASC reserves the right to, at its sole discretion, terminate the access of any person to the Site or to the services available in the Site (in whole or in part), without previous notification, with or without cause.

ASC reserves the right to amend, update or modify these TCs from time to time, in order to comply with the applicable legal requirements.

Except when any law or regulation requires the contrary, if you agree or use any of the services available through the Site, ASC could request your consent to send you any document or information related to the transactions made in or through the Site by means of electronic documents or media. When you consent to receive the documents or information related to transactions made on or through the Site by means of electronic documents or media, you acknowledge and accept that said electronic documents or media comply with any legal requirement for the information to be provided or made available in writing. You may retire your consent at any moment by contacting ASC Sales Office.

These TCs are interpreted in accordance to the laws and regulations of the Commonwealth of Puerto Rico and will be governed by them. In case any claim or dispute arises from or is related to these TCs, the parts will be subject to the jurisdiction of the courts of the Commonwealth of Puerto Rico and waive any right to a claim or defense by lack of jurisdiction.

If for any legal cause or any other reason, the provisions of these TCs are declared null, invalid or not executable, the remaining provisions of these TCs will remain valid and in full effect and the parts will be forced to comply with them fully. The titles and sections of these TCs are for reference and convenience purposes only and do not control or affect the meaning or interpretation of these TCs.

CONFIDENTIALITY POLICY

This web site (including any related web pages, the “Site”) is the property of the Joint Underwriting Association for the Compulsory Motor Vehicle Liability Insurance (“ASC”, for its Spanish acronym).

ASC knows how important it is to maintain our clients’ personal information confidential. To that effect, we describe the practices regarding the collection, use and disclosure of information in this Site on behalf of the ASC.

SECTION A. CONFIDENTIALITY POLICY

ASC is aware of the importance of keeping our clients’ non-public financial personal information confidential. That is why we want to inform you of our Confidentiality Policy, under the Federal Gramm-Leach-Bliley Law (the “Law”), and Rule LXXV of the Puerto Rico Insurance Code Regulations (the “Rule”).

This Confidentiality Policy includes examples of the types of non-public financial personal information that we usually collect and the companies with which we share that information in a limited manner. The examples are illustrative and shall not be considered a full inventory of our information collection, use, and disclosure.

1. Type of information we collect

We collect non-public personal information of the following sources:

a. Information that you have provided, such as name, address, telephone number, license number and information about the vehicles you own in applications and forms.

b. Information that ASC collects as a result of the investigation for the claim presented by you, such as claim history, accident description, statements, photographs, receipt of motor vehicle tag sale, information of any traditional insurance you may have acquired and information about the insured assets that are part of the claim.

c. Information from our members, which are considered “Affiliates” under the Rule, as well as the rating and underwriting companies or from insurance policy information supply companies (ISOs), such as the description and numbers for valid insurance policies with other insurance companies and previous claims.

d. Information on your transactions with us, our “Affiliates”, or others.

2. Information we share

ASC can disclose part or all the information indicated in the previous paragraph.

3. People with whom we share information

ASC shares the information mentioned before with “Affiliates” and with “Non-Affiliated Third Parties” who are permitted by Art. 6 of the Rule to receive disclosed information.

a. Affiliates: Are the “Members” of the ASC, as defined by Art. 6(e) of Law No. 253 of December 27, 1995, also known as Compulsory Motor Vehicle Liability Insurance (“Compulsory Insurance Law”) and Art. 20(d) of OCS Rule LXXI. In accordance with the definition in Art. 2(a) Rule LXXV, the Members of the ASC are considered affiliates.

b. Non-affiliated Third Parties allowed by Art. 6 of the Rule to disclose information: ASC discloses information to Non-affiliated Third Parties who are allowed by Art. 6 of the Rule to receive disclosed information.

In this category we find, among others, rating companies (ISOs), only with regards to the information about insurance policies acquired from the traditional insurance companies and not for marketing purposes. These organizations, persons or companies are required by written contract, to maintain strict confidentiality of the information provided and to limit its use to the exclusive purposes for which said information was provided.

The ASC does not disclose information to any other third party, except those indicated previously, to which the Rule authorizes the disclosure of information. Therefore, ASC does not disclose information to any person or organization, except those authorized by the Rule.

4. Information of previous clients

ASC shares its previous clients’ “non-public financial personal information” and “personal identifying information” in the same way as it shares the information of current clients.

5. Security measures

ASC has implemented physical, electronic, and operational safeguards that comply with the Law and the Rule in order to protect the information of our clients and claimants. We limit the access to the information only to those employees who need it in order to provide services and products to our clients and claimants. Our employees receive guidance on the need for strict compliance with the Confidentiality and Privacy Policy and we take the necessary disciplinary measures to enforce and hold liable those employees who do not comply with it.

6. Changes in the Confidentiality Policy

ASC reserves the right to modify or amend this Confidentiality Policy, which could include changes on the type of “non-public financial personal information” disclosed to non-affiliated third parties. In these cases, we will proceed to send you a revised notification that describes the modifications and amendments and a chance to exercise your right of exclusion regarding the disclosure of your non-public financial personal information to a non-affiliated third party.

7. Right of exclusion

In accordance to the Rule, you have the right to be excluded from the disclosure of your non-public financial personal information to Non-affiliated Third Parties not authorized by the Rule to receive disclosed information. However, currently, ASC does not share information with any “non-affiliated” third parties, except those authorized by the Rule, and the right of exclusion results inapplicable, in accordance to Art. 4, Section 2 of the Rule.

SECTION B. PRIVACY POLICY APPLICABLE TO SITE USERS OR VISITORS

The provisions in this section are applicable to the collection, use or disclosure practices of the information that you provide or that ASC collects within the Site. The provisions are not applicable to the information you provide or that is collected by ASC by any other means.

1. Information we collect on the Site

You can access this Site without providing personal information. However, in order to access or use certain Site sections or services, we require you to register or provide certain personal information. To register and create an access account, you must provide us with the following personal information: your name, last names, email address, telephone number (optional), and date of birth.

When using the services offered on or through the Site or as part of the transactions made with us through the Site, you may also provide us with the following type of personal information: physical or postal address, information of the vehicle involved in the traffic accident, photographs or documents related to the vehicle or accident, among others.

We automatically collect certain information. This information may include your Internet Protocol address, the type of browser, Internet service provider, domain names, operating system, access time and web sites that refer to the Site. ASC may use this information to ensure quality of service, manage the Site, monitor and generate statistics about the visits to the Site.

The Site uses “cookies” to help personalize your experience. A “cookie” is an information file that is stored in your computer’s hard drive from where we could later recover said information in order to identify you when you visit or access the Site in the future. “Cookies” are used for your convenience and to save you time when you visit the Site in the future. Your browser may have the ability to accept or reject “cookies”. If you choose not to accept “cookies” from the Site, it is possible that you may not be able to use or enjoy all the interactive features of the Site.

At the moment, the Site will not use any tool to allow tracking of the users. However, the Site will not assign a value or signal meaning for “do not track” nor will it respond to them.

The information collected may be stored and processed in ASC servers or third party servers contracted by ASC for said purposes.

2. Use and disclosure of the information collected

The information collected by ASC on or through the Site will be used to offer you the services or information you request on or through the Site, complete the transaction with you or comply with the legal requirements applicable to ASC. The information collected may also be used to improve the Site or the services offered on or through the Site. The ASC may also use the information collected on or through the Site to enforce this Privacy Policy, respond or defend your claims or third party claims, protect safety, rights or property of ASC, of its employees, contractors, users of the Site or the general public. The information may also be used for other purposes, such as marketing and advertising. In addition, ASC warns you that it may share the information you provide us to third parties, such as our advertising agency, public relations personnel or digital platform services.

Except as allowed by the applicable laws and regulations or as disclosed in subsection 3 of the Confidentiality Policy (see, Section A, subsection 3, above), ASC will not share, sell, lease or in any other way share the information collected with non-affiliated third parties. However, ASC may disclose any information collected on or through the Site (1) if any law or regulation so requires it, (ii) to comply with an order or information requirement by a court or administrative or government agency, or (iii) when to their best judgment, ASC sees fit or convenient to protect the safety, rights or property of ASC, its employees, contractors, Site users or the general public.

3. Information about minors

The Site content is not intended for people younger than thirteen (13) years of age. ASC will not collect, use or disclose information of any person that ASC knows is younger than thirteen (13) years of age. In the case that ASC receives knowledge that it has inadvertently received personal information about a person younger than thirteen (13) years of age, it will immediately erase and delete said information from its records or archives.

4. Access and opportunity to correct or update your information

You may access some of the personal information collected on or through the Site (including your name, email address, physical or postal address) through the mechanisms provided on the Site at your Profile. You will be able to modify, correct, change or update your personal contact information from the tools and mechanisms available in the following sections of the Site: your Profile.

5. Changes or amendments

The provisions in this section may be amended, modified, altered or substituted by ASC (in whole or in part). ASC will publish in the Site any amendment, modification, alteration or substitution of the provisions in this section. In case any of the changes are significant or material, ASC will provide its clients with a direct notification through email informing them of existing changes and about where they can revisit the new or modified provisions. Any change to the provisions in this section will be applied prospectively, except in those cases where you consent to have them applied to information previously collected by or through the Site. Except when anything else is stipulated in a particular case, the changes or amendments to the provisions in this section will go into effect thirty (30) days after their notification.

6. Other

If any provision of this section (in whole or in part) is declared null, invalid, illegal or contrary to the law, moral or public order, the rest of the provisions will continue or remain in full vigor and effect and the parts will be forced to comply with them to the end. The titles of the provisions in this section are only for reference and convenience and do not control or affect their meaning or interpretation.
